Regulations regarding the purchase and use of the Gift Card

These Regulations are intended to inform our customers about the purchase and use of gift cards, in accordance with the following Terms and Conditions. The Regulations apply to any purchaser (Buyer) and any holder (Beneficiary); Buyer and Beneficiary together are also referred to as “You”); of this gift card (“Gift Card”).
By purchasing and/or holding the gift card, you agree to these Terms and Conditions.

Art. 1. The organizer and issuer of the gift card

1.1. The Organizer and Issuer of the “Terra Trips Gift Cards” is Terranienii Calatoresc S.R.L, a Romanian legal entity, headquartered in street Baboi, no. 105F, Domnești Commune, Ilfov County, Romania, unique registration code 44036634, registered at the Trade Register Office attached to the Bucharest Court under no. J23/2103/2021, Tourism License no. 2404/04.05.2021, hereinafter referred to as the “Organizer”.

1.2. The official regulations are drawn up and will be made public in accordance with Romanian legislation in force, and will be made available to any applicant, free of charge, by accessing the Organizer's website https://terra-trips.com/gift-card-terms-and-conditions/ hereinafter referred to as the "Regulations".

Art. 2. Gift card - definition, characteristics, validity

2.1. The Gift Card is a nominal certificate of value issued by the Organizer and which can be exchanged by the Beneficiary for tourist services offered by the Organizer. The Gift Card can be used to pay, in part or in full, for the value of any Trip type - tourist service from the Organizer, applicable according to these Regulations. The Gift Card is secured with a unique identification code.

2.2. The Gift Card is issued in electronic format (e.g. .jpeg, .png, .pdf, but not limited to these), applicable according to these Regulations.

2.3. The Gift Card is nominal. The Gift Card can only be used by the person for whose benefit it was issued. The purpose of the Gift Card is to advance the payment for a future tourist service to the Organizer. The Gift Card is issued and purchased only in the indicated currency.

2.4. The Gift Card contains at least the following information:

• Beneficiary Name
• Optional - Name of the person who made the purchase (Buyer)
• Gift Card value in EUR
• Gift Card validity period
• The unique identification code of the card

2.5. The value of the Gift Card does not have a predefined value. Its value is given by the amount paid into the Organizer's account.

2.6. Gift Cards will be sent after the order is completed and their value is paid, to the email address sent by the Buyer to the Organizer, at the moment the order was sent.

2.7. Gift Cards are valid for a period of 1 year starting from the Date of Purchase, respectively 365 calendar days. The first day of validity is the Date of Purchase according to art. 2 point 2.8, the card could be used until 23:59 of its expiration date. After the expiration of the validity period, the Gift Card can no longer be used for the purchase of tourist services as defined in these Regulations, its balance being thus considered lost by the Beneficiary. The Gift Card Holder bears full responsibility in relation to the expiration of the validity period and compliance with the date written on the Gift Card, while not being entitled to any compensation from the Organizer.

2.8. The date of the registration of the payment of the Gift Card by the Organizer is referred to in this Regulation as the “Date of Purchase”.

Art. 3. Conditions of purchase/ card filling

3.1. The Buyer can order the Gift Card exclusively through the website, accessing the website: https://terra-trips.com/gift-card/ .

3.2. The amount for the Gift Cards can be paid by payment order, in EUR. Upon request, multiple Gift Cards can be issued for a single order, specifying the value that each Gift Card must have.

3.3. The Buyer has the option to print the Gift Card, send it immediately or later to the Beneficiary, at his/her own choice.

3.4. The Beneficiary has the possibility to use the Gift Card to purchase Trips from the Organizer according to the definition in art. 2. point 2.1.

3.5. Gift Cards cannot be received in the following cases:
3.5.1. If the messaging anti-spam filter blocked the attached document or redirected the message to the "Spam" or "Junk E-mail" folder;
3.5.2. The firewall blocked the message or the attached document;
3.5.3. Your mailbox has reached its size limit;
3.5.4. The e-mail address is invalid.

3.6. The Gift Card can only be used in exchange for a Trip/Trips carried out by the Organizer. The Gift Card cannot be exchanged for money. The Gift Card can be returned within 14 days from the Date of Purchase (defined in point 2.8), but only to the person who made the payment and for justified reasons.

3.7. To use the Gift Card to partially or fully pay for one or more Trips carried out by the Organizer, the Beneficiary must contact the Organizer exclusively by email at contact@terra-trips.com to express their desire to use its value.

3.8. If the price of the Trip/Trips you wish to purchase from the Organizer is higher than the value of the Gift Card, the difference can be paid by payment order. The Gift Card can be used only once, so after purchasing the Trip/Trips, the value of the Gift Card becomes null. If the Gift Card is not used at its full value, then no change is given after using it.

3.9. The exchange of Gift Cards for services is the exclusive right of the Gift Card Beneficiary. If there are doubts regarding the identity of the holder at the time of exchanging the Gift Card, the Organizer reserves its right to legitimize him/her. If the Gift Card holder cannot prove his/her identity, the Organizer will not make the exchange for Trips, and the paid amount will remain stored in the account until the identity is proven within the time limits established in these Regulations.

3.10. When purchasing a Gift Card, ownership is transferred from the Organizer to the Buyer starting from the date of issue of the Gift Card. The Buyer is fully responsible for the transmission of the Gift Card to the Beneficiary.

3.11. Also, as soon as the Buyer transfers the Gift Card to a Beneficiary, the latter is presumed to fully accept the assignment and sale conditions of the Gift Card that are specified in these Regulations.

3.12. If the Beneficiary has registered and used the Gift Card for a Trip that the Organizer subsequently cancels, in this case, the use of the Gift Card is also canceled. Thus, the Beneficiary will be recredited, free of charge, with the value of the Gift Card that was used to pay for the Trip and can be reused for a new Trip according to the conditions of these Regulations. In this case, the validity of the Gift Card is extended by 1 year starting from the date on which the Organizer notifies the Beneficiary by email of the cancellation of the trip.

3.13. If the Beneficiary cancels participation in a Trip after registering and using the Gift Card, the value of the Gift Card becomes null and void.

3.14. In case of loss of the electronic support of the Gift Card, the Beneficiary must contact the Buyer to obtain another electronic copy. If the Buyer has lost the electronic support himself (due to deletion, for example, of the electronic message containing it), he will be able to receive an electronic copy based on a request addressed to the Organizer at the email address: contact@terra-trips.com. In this case, the electronic copy will be resent to the Buyer's email address originally used for the purchase. Under no circumstances is it possible to obtain a reissue of the Gift Card, as a new code.

3.15. In no case other than that mentioned in point 3.14., the Organizer assumes no liability and will not replace the Gift Card in case of theft, loss, forgery or damage. In these situations, the balance of the Gift Card is considered lost, and no compensation is possible in connection with the event that led to the impossibility of using the Gift Card by its holder.

3.16. If the Beneficiary changes his personal data, such as his/her last name in case of marriage or divorce, he/she will declare the change of data by sending a notification to the email address: contact@terra-trips.com.

3.17. The Beneficiary may transfer the Gift Card to another person, to whom the ownership is transferred and who becomes the new Beneficiary, providing a notification with the name of the new Beneficiary to the Organizer by email at contact@terra-trips.com and receive confirmation from the Organizer that the name change has been processed in its records. The cumulative condition for the application of this article is that the Organizer is informed before the Beneficiary expresses his right to use it, otherwise the request to change the Beneficiary's name becomes null and void. The other conditions for applying the Gift Card, including its validity period, do not change.

3.18. A purchased Gift Card does not benefit from the application of any ongoing promotional campaign. Also, promotional campaigns do not apply to the value of the Gift Card that is used to pay for one or more Trips.

Art. 4. Products / Services that can be purchased via Gift Card

4.1. Based on the Gift Card, tourist service packages (hereinafter referred to as “Trips”) sold by the Organizer can be purchased), under the conditions specified in these Regulations.

4.2. Also, the Gift Card cannot be used to pay for tourist services that are not included in the trip or that are mentioned as optional and/or additional services, such as, for example, optional excursions, but not limited to these.

Art. 5. Participation right

5.1. The Gift Card may be purchased by any natural person over 18 years of age or any legal entity who wishes to offer a Gift Card and who accepts the terms and conditions of these Regulations (hereinafter referred to as “You”). The person who pays for the order is hereinafter referred to as the “Buyer”, and the person who receives the Gift Card from the Buyer is hereinafter referred to as the “Beneficiary”.

5.2. Gift Cards can be purchased by natural persons or legal entities, regardless of whether they have their domicile or residence in Romania or not, if they cumulatively meet the conditions stipulated in these Regulations.

5.3. It is strictly forbidden to purchase Gift Cards for resale or marketing purposes, except for purchases that are the subject of Organizer’s separate contractual relationships with legal entities and that may have marketing purposes. Failure to comply with this obligation entitles the Organizer to request compensation for all damages caused by failure to comply with this clause, having the right to prove it by any means of evidence.

5.4. The Organizer reserves the right, at its absolute discretion, to take all necessary measures, including canceling the participation of any person who does not comply with these Regulations, who is suspected of fraud, who acts in an unethical or disruptive manner, or who is determined to be acting with the intention of disturbing, abusing, threatening or harassing any person, without having to prove it with evidence.

5.5. In case of attempted or fraudulent use of the system, abuse or any acts directed against and at the Organizer, the Organizer reserves the right to take all necessary measures to remedy the situation and hold those responsible accountable under the law, including but not limited to disqualifying participants, as well as appropriate legal measures.

5.6. The Organizer does not assume responsibility for the impossibility of purchasing the Gift Card due to software errors or circumstances that do not directly depend on the Organizer, such as technical malfunctions of the internet service provider, etc.

5.7. The organizer will take all necessary measures to sell the Gift Card under normal conditions as presented, but does not assume responsibility for any dissatisfaction or complaints from participants that do not concern violations of the legal framework in force.

Art. 6. Interruption, modification and cessation of the sale of the Gift Card

6.1. The Organizer reserves the right to modify these Regulations whenever necessary, having the obligation to publish the new Regulations on the website https://terra-trips.com/. The changes are enforced after they are published on the website at: https://terra-trips.com/gift-card-terms-and-conditions/.

6.2. If, for any reason, the sale of the Gift Card cannot be carried out in accordance with these Regulations due to causes beyond the control of the Organizer, fraud, technical problems or any other causes that may affect the administration, security, fairness, integrity or proper conduct of the sale of the Gift Card, the Organizer reserves the right to cancel, terminate, modify or suspend its sale. In the event of termination due to fraud or technical difficulties, an official announcement will be made via the website https://terra-trips.com/.

Art. 7. Personal data protection

7.1. The Organizer undertakes to comply with the provisions of Regulation 2016/679 EU on the protection of individuals regarding the processing of personal data and the free movement of such data. Thus, the Organizer undertakes to maintain the confidentiality of the personal data of individuals and to use them in accordance with this Regulation and the legislation in force.

7.2. The organizer may disclose personal data provided by individuals to public authorities, upon their express written request or if there are suspicions of the commission of a crime.

7.3. Pursuant to legal provisions, individuals have the following rights in relation to personal data:

• The right to access personal data and to request a copy of them;
• The right to request the rectification or completion of inaccurate or incomplete personal data;
• The right to request the deletion of processed personal data, to the extent possible and in accordance with applicable laws;
• The right to withdraw, at any time, the consent granted for this processing, without affecting the legitimacy of the processing before the date of withdrawal of consent, if this consent was used in the collection of data;
• The right to obtain restriction of processing, if the accuracy of the processed data or the legitimacy of the processing is contested;
• The right not to be subject to a decision based solely on automated processing (profiling);
• The right to receive the data provided or observed in a structured format and to request their direct transfer to another operator;
• The right to file a complaint with the National Authority for the Supervision of Personal Data Processing.

7.4. To exercise these rights, individuals may submit a written, dated and signed request (on paper/in electronic format) to the e-mail address: contact@terra-trips.com or through registered letter at SC Terranienii Calatoresc S.R.L, headquartered in Baboi Street, No. 105F, Domnești Commune, Ilfov County, Romania.

Art. 8. Litigation

8.1. In the event of any disagreements arising between the Organizer and You, related to the service purchased, these will first be resolved amicably. If this is not possible, any dispute will be submitted to the Romanian competent courts for resolution.

Art. 9. Final provisions and applicable law

9.1. Complaints regarding the purchase of the Gift Card will be made in writing and will be sent to the email address contact@terra-trips.com or at the Organizer’s headquarter: SC Terranienii Calatoresc S.R.L, Baboi Street, No. 105F, Domnești Commune, Ilfov County, Romania, by registered letter with receipt confirmation, with the mention “Gift Card”

9.2. Any complaint related to the purchase of the Gift Card will be addressed within 10 (ten) business days from the date on which the event complained of occurred, but no later than the 14 calendar days allocated for the possibility of returning the Gift Card and requesting the related refund. Complaints submitted by phone or late will not be processed.

9.3. The Organizer will take all necessary measures to carry out the selling of the Gift Card under normal conditions as presented, but does not assume responsibility for any dissatisfaction or complaints from participants that do not concern violations of the legal framework in force.

The selling of the Gift Card is subject to Romanian law.

This Regulation enters into force on 07.05.2025.
